    Access to and use of the services offered by ICEERS’ website confers the condition of SERVICE USER and implies full and unreserved acceptance of each one of the Additional Conditions published in this Legal Notice and other documents and forms provided during the use of these services. These conditions may be modified by ICEERS, who will notify you of such changes as far in advance as possible.

    It is therefore advisable to read its contents carefully in case you wish to access and make use of the website and/or the services offered.

    All notifications and communications between users and ICEERS shall be considered effective, for all purposes, when made by any of these channels.

    4. Intellectual and industrial property

    All contents of the website, such as text, photographs, graphics, images, icons, technology, software, as well as graphic design and source codes, constitute a work whose property belongs to ICEERS itself or as an assignee The use of this website does not grant any intellectual propriety rights to the users beyond what is strictly necessary for the proper use of the web.

    In short, users who access this website may view the contents and make, where appropriate, authorized private copies if the elements reproduced are not subsequently transferred to third parties, nor are they installed on servers connected to networks, nor are they subject to any type of commercial exploitation.     The use of any of the Support Services implies the full and unreserved acceptance of the General Conditions of the website, of these Additional Conditions and of any other Particular Conditions that may be applicable and that are communicated to the SERVICE USER by the Support Services management teams.

    In case of disagreement with all or part of these General and/or Additional Terms and Conditions, the SERVICE USER must refrain from continuing to use the Support Services.

    6.1. SUPPORT SERVICES.

    • The Interac Service: Interac, an information service on interactions between psychoactive plants and drugs or medical treatments.
    • The Support Center/Helpdesk is an accompaniment service for people who experience difficult processes with psychoactive plants. This service gives support and facilitates integration processes. This service is not and cannot replace a psychological, psychotherapeutic, or psychiatric consultation. This service does not encourage the use of psychoactive plants.
    • The Ayahuasca Defense Fund (ADF) provides legal and advocacy strategies in legal incidents involving psychoactive plants. This service is not and cannot replace a legal consultation with a lawyer, nor their work in case of litigation.

    ICEERS reserves the right to decide, from time to time, the Support Services offered to users and to establish additional requirements for their access. Thus, ICEERS may, at any time, add new Support Services to those currently offered. ICEERS also reserves the right to withdraw or cease to offer, at any time, any of the Support Services offered.

    6.2. CONDITIONS FOR ACCESS TO SUPPORT SERVICES

    To use ICEERS services, you must be at least 18 years old.

    Access to and use of ICEERS Support Services is completely voluntary and free of charge. Users do not contract or purchase any service through the website. Users are individuals accessing the Support Services.

    To access the Support Services, you must follow all the instructions indicated on the website itself and/or provided by the Support Services management team.  You must follow all the required steps to access the Support Services, including reading and accepting all the terms of use set forth herein.

    ICEERS reserves the right to decide, from time to time, specific access requirements for each Support Service. Simply requesting the Support Services does not guarantee that ICEERS will provide Support Services to you. ICEERS also reserves the right to withdraw or cease to offer, at any time, any of the Support Services to users in case they breach these Terms of Use, based on their unfair behavior, or their bad faith or for any cause beyond their control.

    6.2.1 Registration

    To access some of the Support Services, it is necessary to register by filling out the access forms and, if applicable, by registering in the platforms and services used to communicate with the Support Services professional teams.

    6.2.2 Processing of Personal Data

    To access the Support Services, you will be required to complete an access form and provide us with certain personal data that in any case will be truthful, accurate and complete. The processing of this personal data is necessary for the provision of the Support Service; To access the Services you must expressly consent to ICEERS processing your data by accepting ICEERS Privacy Policy.

    By requesting ICEERS’ services, you authorize us to share information with other professionals in the following circumstances:

    • If there is sufficient reason to believe that a third party is required to ensure your safety (in connection with abuse, neglect, exploitation, or abandonment). Your data may be transferred to the local agency providing the social services that the situation requires.
    • If you manifest a serious threat, or intent to kill or seriously injure a person or group of persons who can be personally identified, and if there is sufficient reason to believe that you may carry out such a threat, reasonable steps will be taken to prevent any harm. These reasonable measures may include notifying the potential victim of the threat and the relevant authorities.
    • If there is sufficient reason, based on the professional judgment of the service team, to suspect that there is a child abuse situation.

    Confidentiality

    During the use of the Support Services, you may have access to information about the procedures and methodologies of the Support Services, ICEERS or the persons managing the Support Services. You expressly undertake, both during the use of the Support Service and after its termination, not to disseminate, transmit, disclose to third parties any information to which you have access because of your use of the Support Services or to use such information in your own interest or in the interest of your relatives or friends.

    6.3 EXCLUSION OF WARRANTIES AND LIABILITY IN THE ACCESS AND USE OF THE SUPPORT SERVICES.

    You voluntarily accept to make use of the Support Services offered by ICEERS, understanding the characteristics of the same.

    ICEERS makes no express or implied warranties, guarantees, or representations as to its Support Services. This includes, but is not limited to, implied warranties as to the quality, accuracy, completeness, legality, reliability, efficacy, or fitness for a particular purpose.

    The Support Services provided are not and are not a substitute for medical, psychological, psychotherapeutic, psychiatric, or specialized legal care. They are not intended to diagnose any disease or medical condition, or prescribe any type of treatment, or legal and/or judicial action.

    ICEERS shall not be liable for any consequences of any kind that may arise from the lack of truthfulness, accuracy and completeness of the data provided by users through the website, its forms and / or subsequent communications.

    Any action or lack of action taken by you is solely your decision and responsibility and is not ICEERS responsibility.

    The information and advice offered through the Support Services are not intended to encourage the use of ethnobotanicals. ICEERS specifically cautions against the use of ethnobotanicals in violation of the law, without appropriate professional guidance and monitoring, or without careful personal evaluation of potential risks and hazards.

    ICEERS shall not be liable for any damages or losses that may occur to users of the Support Service as a result of network failures or disconnections, and the suspension, cancellation or interruption of the Support Services due to third-party software failures.

    You undertake to hold ICEERS harmless from any claims arising from incidents arising from any of the causes described above. ICEERS shall indemnify users only if the damages caused are due to ICEERS’ gross negligence or wishful misconduct duly accredited by the claimant. In no event shall ICEERS be liable for moral damages, loss of profit and/or any consequential or indirect damages.

    7. Additional Conditions of ICEERS’ Training Services.

    These Additional Conditions regulate the USE and ACCESS to the training services offered on this website (hereinafter, and jointly, the Training Services).

    The use of any of the Training Services implies full and unreserved acceptance of each one of the General Conditions of the website, of these Additional Conditions and of any other Particular Conditions that may be applicable and that may be communicated to you through the different Training Services.

    These Additional Conditions may be modified without prior notice, therefore, it is advisable to read their contents carefully before proceeding to access any of the Training Services.

    If you disagree with all or part of these General and/or Additional Terms and Conditions, you must refrain from continuing to use the Training Services.

    7.1. TRAINING SERVICES.

    • Integration and support course: In order for health professionals to provide adequate support to people who decide to undergo such experiences with psychoactive plants, it is vital to develop a complete understanding of these practices. Through this training you will assimilate the contexts of use, pharmacology, effects, risks, and potential benefits, as well as effective strategies for crisis intervention.
    • Cannabmed Campus: It is an online training initiative on cannabis, health, and society. You can access the complete training or attend the seminars individually.

    ICEERS reserves the right to decide, from time to time, which Training Services are offered and to establish additional Access requirements. ICEERS might, at any time, add new Training Services to those currently offered. ICEERS also reserves the right to withdraw or cease to offer, at any time, any of the Training Services currently offered.

    7.2. CONDITIONS FOR ACCESS TO TRAINING SERVICES

    In order to use ICEERS services, you must be of legal age. (Over 18 years old)

    Access to and use of ICEERS Training Services is completely voluntary. Training Services Users are individuals and professionals accessing the Training Services.

    To access the use of the different Training Services, you must follow all the instructions indicated on the website itself and/or provided by the persons in charge of the management of the Training Services. You must complete all the steps to access the Training Service, including reading and accepting all the conditions of use set forth herein.

    ICEERS reserves the right to decide, from time to time, specific access requirements for each Training Service. Simply requesting the Training Services does not guarantee that ICEERS will provide the Training Services to you. ICEERS also reserves the right to withdraw or cease to offer, at any time, any of the Training Services to the users of the Training Services in case they breach these Terms of Use, based on their unfair behavior, or their bad faith or for any cause beyond their control.

    7.2.1 Registration

    To access some of the Training Services it will be necessary to register by filling in the access forms and, if applicable, registering in the platforms and software and online communications services used to communicate with the team of professionals of the Training Services.

    7.2.2 Processing of Personal Data

    To access the Training Services, you will need to complete an access or registration form where you will provide us with certain personal data that in any case shall be truthful, accurate and complete.     7.3 EXCLUSION OF WARRANTIES AND LIABILITY IN THE ACCESS AND USE OF THE TRAINING SERVICES.

    You voluntarily agree to make use of the Training Services offered by ICEERS, understanding what its characteristics are.

    The Training Services provided are neither a substitute for nor a substitute for formal training provided in public or private accredited training centers. The trainings offered by ICEERS are not regulated by the Ministry of Education and Vocational Training and, therefore, have no official academic validity.

    ICEERS shall not be liable for any consequences of any kind that may arise from the lack of truthfulness, accuracy, and completeness of the data you have provided us with through the website, its forms and/or subsequent communications.

    ICEERS shall not be liable for any damages or losses that may occur to users of the TRaining Service as a result of network failures or disconnections, and the suspension, cancellation or interruption of the Support Services due to third-party software failures.

    Donations can be made on the ICEERS website through the account number indicated on the website.

    In case you would like ICEERS to issue a tax certificate the organization would need the following data from the interested persons.

    ICEERS informs that it will proceed to process the data in a lawful, loyal, transparent, adequate, relevant, limited, accurate and updated manner.

    10. SSL (Secure Sockets Layer) Certificate

    The SSL CERTIFICATE provides authentication, privacy, and security of information between ICEERS and users. ICEERS has a security certificate that is used by SSL CERTIFICATE to make secure connections. In this process several parameters are established to make the connection securely and is established using pre-established keys, encrypting, and decrypting all data sent until the connection is closed.

    11. Legal actions, applicable law, and jurisdiction.

    ICEERS reserves the right to file civil or criminal actions it deems appropriate for improper use of its website, its services and content, or for breach of these conditions.

    The relationship between users and ICEERS shall be governed by the regulations in force and applicable in Spain. If any dispute arises, the parties may submit their disputes to arbitration or go to the ordinary jurisdiction in compliance with the rules on jurisdiction and competence in this regard.
